1. Initial Provisions
These business conditions relate to the purchase of completed or custom-made products through the internet service of www.2dto3dstudio.com which is established and operated by the entity 2Dto3D Studio / David Borovička (seller) headquartered in Květná street 1093/17, 697 01 Kyjov, Czech Republic, ID 76296393, by the office responsible according to Article 71, paragraph 2 of the Trade Law being Municipal Office in Kyjov. These business conditions further specify rights and responsibilities of the seller and their customers (purchasers/consumers).
 
2. Definitions
2.1 A Consumer Contract, a Purchase Contract or A Contract for the Production of a Work are contracts in which there is a consumer (buyer) on one side and a seller on the other.
 
2.2 In this case, the seller is 2Dto3D Studio / David Borovička, headquartered in Květná street 1093/17, 697 01 Kyjov, Czech Republic, ID 76296393, by the office responsible according to Article 71, paragraph 2 of the Trade Law being Municipal Office in Kyjov.
 
2.3 The consumer (buyer) is a person at the time of concluding and fulfillment of the contract does not represent themselves within their business or other trade activity. These contractual relations are subject to the Civic Code (Nr. 40/1964 Coll.) as well as the Consumer Protection Act (Nr. 634/1992 Coll.).
 
2.4 A business entity is a buyer who is not a consumer. A business entity purchases products or uses services for the purpose of their trade activity with these products or services. The contractual relations with such business entity are subject to business conditions in the scope to which they pertain to the Commercial Code Nr. 513/1991 Coll., in the version of later amendments.
 
3. User Account
3.1 When registering at the 2dto3dstudio.com website and when ordering products and services, the buyer is required to provide all data accurately and truthfully. The buyer is obliged to update any data provided by the user in their user account in case of a change. The data provided by the buyer in the user account are considered to be correct when ordering goods. Should this data fail to be correct, the seller is not responsible when sending products to the buyer at an incorrect address or possible other complications caused by this fact.
 
3.2 The buyer is not entitled to allow third parties to use the user account.
 
4. Conclusion of a Purchase Contract
4.1 The 2dto3dstudio.com internet service includes a list of products offered for sale, including the stated prices of the individual products. The selection of products for sale and prices are valid for as long as they are displayed.
 
4.2 The buyer sends an order to the seller by filling the appropriate form in Custom Model section of the webiste. The order in this condition is considered to be the buyers Purchase Contract proposal.
 
4.3 The actual Purchase Contract is concluded at the moment of delivering the binding confirmation on the part of the seller. A binding confirmation is understood to be an e-mail confirmation or a phone confirmation. The binding confirmation is not the review of the order which the customer receives automatically via e-mail upon placing the order in the E-shop, etc.
 
4.4 The buyer is responsible for costs incurred to the buyer for using long-distance communication methods in relation to the conclusion of the Purchase Contract (phone call costs abroad, etc.).
 
5. Payment Method for Offered Products and Services
5.1 PayPal – to pay for a custom-made product, the customer will be transferred to the payment gateway of PayPal. Here the buyer can choose either a payment from their PayPal account or a payment using a debit/credit card. In the first case, it is sufficient to enter their login and password and confirm the payment. In case of a payment card, it is necessary to select this option and enter the 16-digit number of the card as well as the CVC/CVV code. The entering and transfer of information is handled outside the servers of our studio and are subject to the security standards of the PayPal payment gateway. The delivery time begins upon the entire amount being credited to our account.
 
6. Product Delivery
6.1 There is no charge for digital delivery, therefore the buyer only pays for the actual digital data. The buyer receives a link to the download of the data and this link is sent via e-mail to the e-mail address provided by the buyer.
 
7. Withdrawal of the Purchase Contract from the Side of the Buyer
7.1 In case a customer receives a digital model with a license, according to Article 53, paragraph 8 of Act Nr. 40/1964 Coll., the Civil Code of the Czech Republic, it is not possible return the goods within 14 days from the conclusion of the Purchase Contract. In general, digital data are considered non-returnable items, given their “digital nature” they cannot be returned in the way a physical product could be. This digital nature also ensures that they shall never be damaged in the way physical products may be and they never come to spoilage on their own. Digital data may only be damaged or lost in case there are technical problems with the data carrier on which they are placed. Each buyer owns and maintains their own data carriers and our studio is not responsible for possible technical problems in this regard. As soon as digital data are delivered to the buyer, their return and withdrawal from the contract is not possible, because returning them to the seller would always produce a digital copy while the source data remains in its original place. Technically speaking, it is not possible to return digital data and expect a return of the purchase cost back to the buyer. Therefore, please think through whether you are interested in the given digital products, because the order of a digital product is always binding.
 
8. Guarantee and Complaints
8.1 The guarantee comes to effect on the day the product is received by the consumer. There is a 24 month guarantee provided for our products.
 
8.2. A complaint for digital products can be submitted via e-mail. In case of a complaint, it is necessary to describe the character of the flaw and supply a copy of the purchase receipt (or otherwise prove the purchase) and provide your contacts. We resolve each complaint without undue delay, maximum within 30 calendar days.
 
8.3. In regard to point 7.1 about the nature of digital data, it is only possible to file a complaint for digital data in the following cases:
 
In case the buyer received a different digital model than the one ordered
 
In case the digital model sent to the client contains flaws. Among flaws are considered a missing part of the polygon mesh, holes in the polygon mesh and similar flaws that differentiate the digital model from the presented image, which was provided to the buyer and according to which the buyer made their selection when purchasing. Among the digital flaws not included are the polygon data mesh used by us (polygon triangles) and possible incompatibility of data with the buyer’s software, etc.
 
9. Conclusion
9.1 The seller is entitled to sell the products offered at the website based on the trade license and the activity is not the subject of any further approvals. The trade control is applied by the respective Trade Office within the scope of its responsibilities.
 
9.2 By ordering products via electronic order or by phone, the buyer accepts these business conditions without exception in the version stated at the website on the date of placing the order. The buyer also accepts the purchase price of the ordered products.
 
9.3. By sending their order, the buyer confirms that they are acquainted with these business conditions and that they agree with them.
